Warranty Policy
AGAP TEXAS ENGINES (AGAP)
warrants to the original purchaser that each product sold by AGAP shall be free of
defects in material and workmanship under normal use and with
periodic maintenance as set forth by the original manufacturer and
in accordance with the schedules and limitations outlined
below. Repairs or
replacement will be made at the AGAP factory within a reasonable
time after written notice and upon receipt of the goods deemed to
be defective per the schedules and limitations of our written
warranty. An
authorization number must be received prior to repair or
replacement of goods.
LIMITED WARRANTY: This warranty is given in lieu of
all other warranties, expressed or implied, including any warranty
or merchantability, or fitness for a particular purpose, on the
part of AGAP or the
dealer installing the engine. No dealer nor any agent or
employee thereof, is authorized to extend or modify this warranty.
AGAP’s liability under
this warranty is limited solely to the repair or replacement of
defective product. AGAP
shall not be liable for any incidental, special, consequential or
exemplary damages, including but not limited to rental cars, towing
fees or for any service not expressly provided for herein, relating
to or arising from the AGAP product.
APPLICATION - The warranties listed below
apply to passenger cars and light trucks with a Gross Vehicle
Weight of 8,000 pounds or less except as noted and when used in
vehicles for which the engine was designed.
SHORT BLOCKS – The standard
warranty for Short Blocks shall exist for 6 months or 6,000 miles
whichever occurs first. This warranty covers parts and
materials only.
Labor coverage for removal and
reinstallation may be purchased for an additional cost of 8% of the
purchase price.
Maximum labor on Short Blocks shall not exceed the purchase price
of the unit.
The warranty time period for Commercial Application
is for 30 days or 1000 miles whichever occurs first and for
Industrial, Recreational and Marine application is 30 days parts
only.
LONG BLOCKS – The standard
warranty for Long Blocks shall exist for 12 months or 12,000 miles
whichever occurs first. This warranty covers parts and
materials only. Labor
coverage for removal and reinstallation may be purchased for an
additional cost of 5% of the purchase price.
An extended warranty for 36 months or
50,000 miles, whichever occurs first and covering both parts and
labor may be purchased for an additional cost of 12% of the
purchase price.
The warranty time period for Commercial Application
and Diesel engines is for 6 months or 6,000 miles whichever occurs
first and for Industrial, Recreational and Marine application is 30
days parts only.
SIGNATURE SERIES PREMIUM LONG
BLOCKS – The standard warranty for SS Long Blocks shall exist
for 36 months with unlimited mileage covering both parts and
labor.
The
warranty time period for Commercial Application and Diesel
engines is for 6 months or
6,000 miles whichever occurs first and for Industrial, Recreational
and Marine application is 30 days parts only.
TERMS AND CONDITIONS
1.
All authorized repairs will be compensated at a
rate not to exceed 100% of the applicable flat rate schedule as
published by Chilton, Mitchell or Motors Repair Manuals. Hourly
rates for all authorized labor claims will be paid in accordance
with the original installation rate, not to exceed $20.00 per flat
rate hour, with a maximum of $300.00. Do-it-yourself repairs, and
repairs performed by unlicensed repair facilities, will be paid at
a rate not to exceed $12.00 per flat rate hour. The total value of
the claim may never exceed the price of the part that is being
replaced or repaired in such claim.
2.
Product replaced under warranty carries the
remainder of the original product’s warranty term.
3.
Buyer specifically acknowledges that the
components purchased will require additional components and must be
properly installed or the warranty will be void. The limited warranty will be void
and not apply to defects or failures caused by (1) over revving (2)
accident, abuse or an operation for which it was not designed (3)
damaged or inefficient parts, components or accessories not
included in the sale (see installation Guide attached to product)
(4) dirty or improper installation (5) overheating and/or freeze
cracks to blocks, heads or drive cases (6) burned or melted pistons
(7) lack of lubricants or fluids (8) extensive corrosion damage to
stern drive (9) detonation or pre-ignition (10) burned thrust
bearings caused by rear pressure.
4.
Buyer specifically acknowledges that proper
maintenance procedures which include, but are not limited to,
changing or calibrating as applicable the filter, lubricant,
harmonic balancer, fan hub, water pump, fuel injectors, fuel pumps,
hoses, belts, etc., must be performed as recommended by the
original manufacturer or the warranty will be void.
5.
Proper installation procedures must be followed
to avoid accident or injury.
6.
AGAP’s limited warranty will end
after the expiration of time or mileage from the date of the
original invoice. Any
repairs or replacement will not extend the warranty. The buyer shall be responsible
for all defects, thereafter, regardless of cause.
7.
AGAP’s limited warranty is in
lieu of all other warranties expressed or implied and AGAP makes no warranty of
merchantability for fitness for a particular purpose.
8.
The buyer must notify AGAP of any warranty claim prior
to repair for assignment of an authorization number. The work will be performed either
at AGAP’s factory or by
another selected vendor. It is the sole responsibility of
the buyer to pay for such work and, in writing, submit a claim with
the alleged defective parts shipped prepaid to AGAP for its review and sole
determination.
9.
Buyer agrees that AGAP will not be responsible for
(1) incidental or consequential damages (2) lost profits, sales or
income (3) injury to person or property (4) oil, antifreeze, fluids
or other substances (5) towing charges (6) lift, dock or storage
fees (7) telephone calls (8) freight (9) substitute transportation,
lodging, etc. (10) unauthorized repairs (11) labor on a gasket kit,
oil pump, lifters or other accessory parts purchased with the
engine.
10.
Buyer and seller agree the seller's price is
based upon this limited warranty. Buyer and seller also agree the
buyer's sole and exclusive remedy against seller on account of
breach of contract, warranty or performance, shall be for the
repair or replacement at AGAP’S factory, of defects in AGAP’S factory workmanship
or material within the periods of this warranty. The buyer will be responsible for
shipment and subject to the limitations and conditions of this
warranty.
11.
No benefits or remedies are available under this
limited warranty while the invoice for the unit or related services
remains outstanding.
12.
Initial Startup: Valves must be readjusted to
manufacturer's specifications. Due to various component designs,
cylinder head re-torque may or may not be required in your
particular application. Refer to factory shop manual for
the proper procedure for your engine type. If for any reason you are unsure

13.
First Service Between 600-1000 Miles After
Installation: Oil and
oil filter must be changed, valves readjusted and cylinder heads
re-torqued (refer to initial startup instructions).
14.
Exclusions: Any form of racing or competitive
use of any engine.
